Spin Voyage provides its services to clients subject to the following Terms of Use, which may be updated by Spin Voyage from time to time without notice to clients.

Responsibility

Spin Voyage is not a travel agency. Spin Voyage provides vacation planning services, but does not act as the provider of transportation, accommodation, or any other travel or entertainment services. Spin Voyage acts as a liaison between the client and the client’s selected travel agency or agencies. Spin Voyage is not an agent of any travel agency.

Accuracy of Information

Spin Voyage shall not be liable for errors, loss, injury, or inconvenience resulting from the use of the information it provides as part of its services, or on its website. No warranty, express or implied, is given that the information provided on this website or in the vacation planning services provided is error-free.

Privacy Policy and Security

In order to protect privacy and personal information, Spin Voyage agrees that it will not distribute any personal details that have been passed on to us without explicit prior permission. Personal information provided by clients when requesting more information is shared only with the travel agency selected by the client.

Travel Insurance

Travel Insurance is recommended to protect clients from costs related to trip cancellation, baggage delay, medical treatment, and emergency medical transportation.

Disclaimer of Warranty; Limitation of Liability

Spin Voyage clients also agree to the follow Terms and Conditions:

(A)   SPIN VOYAGE ACTS ONLY AS AN AGENT FOR ITS CLIENTS WITH RESPECT TO ARRANGEMENTS FOR ACCOMMODATIONS, SERVICES, AND/OR TRANSPORTATION. SPIN VOYAGE EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR INJURY, DAMAGE, DELAY, ACCIDENT OR IRREGULARITY INCURRED BY THE CLIENT IN CONNECTION WITH THE SERVICES OF ANY ACCOMMODATION, AIRPLANE, SHIP, TRAIN, OR OTHER CONVEYANCE INVOLVED IN THE IMPLEMENTATION OF TRAVEL ARRANGEMENTS. THE CLIENT’S CONTRACTUAL RELATIONSHIP WITH RESPECT TO ALL ACCOMMODATION, TRANSPORTATION, OR SERVICE ARRANGEMENTS SHALL BE SPECIFICALLY WITH THE PARTICULAR PROVIDER, THEREOF, AND ALL CLAIMS OR LOSSES ATTENDANT THERETO SHALL BE STRICTLY BETWEEN THE CLIENT AND THE PROVIDER, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE PROVIDER’S CONTRACTUAL DOCUMENTS AND AGREEMENTS.

(B)    CLIENT EXPRESSLY AGREES THAT USE OF THE SITE AND ANY SPIN VOYAGE SERVICES IS AT CLIENT’S SOLE RISK. SPIN VOYAGE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICES, PROVIDED THROUGH THE SITE.

(C)    THE SITE IS PROVIDED ON AN ”AS IS“ BASIS. SPIN VOYAGE MAKES NO IMPLIED OR EXPRESS WARRANTIES WITH RESPECT TO ITS WEBSITE AND ANY SERVICES, AND SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES FOR MECHANTABILITY, AND FITNESS FOR ANY PARTICULAR PURPOSE.

(D)    IN NO EVENT SHALL SPIN VOYAGE’S LIABILITY RELATED TO THIS WEBSITE OR ANY SERVICES EXCEED THE PURCHASE PRICE ACTUALLY PAID. IN NO EVENT SHALL SPIN VOYAGE BE LIABLE TO THE CUSTOMER OR ANY THIRD PARTY FOR ANY DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF, OR RELATING TO, THIS WEBSITE OR ANY SERVICES PROVIDED OR TO BE PROVIDED BY SPIN VOYAGE, OR THE INABILITY TO USE THE SAME, EVEN IF SPIN VOYAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms of Use constitutes the entire agreement between client and Spin Voyage and governs client’s use of all services provided or offered by Spin Voyage, superseding any prior agreements between client and Spin Voyage with respect thereto. Client also may be subject to additional terms and conditions that may apply when client use or purchase certain other Spin Voyage, affiliate or third party property services or products.

These Terms of Use and the relationship between client and Spin Voyage shall be governed by the laws of the State of California without regard to its conflict of law provisions. Client and Spin Voyage agree to submit to the personal and exclusive jurisdiction of the courts located within Contra Costa County, California. The failure of Spin Voyage to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect. Client agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of any Spin Voyage service or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred. 

Indemnification

To the extent permitted by law, clients agree to indemnify and hold harmless Spin Voyage from any claims or demands, including reasonable attorneys’ fees, made by any third party due to or arising out of clients acts or omissions relating to the services provided or offered by Spin Voyage.
